Abstract

The presumption of innocence of the accused has become a criminal and constitutional procedural presumption that boasts of approving charters and laws. This presumption has become more than one benefit and more than one rule has emerged from it, such as: the origin of the human being is innocence, and the accused is innocent until proven guilty, and doubt is interpreted in favor of the accused, and the insufficiency of one testimony for the verdict, and the construction of the penal judgment on certainty and certainty not on doubt and conjecture, and so on, so the importance of assuming the acquittal of the accused lies in its connection with human rights, freedom and origin, which requires the investigation and trial authorities to deal with the accused on the basis that he is innocent because that is the origin until the contrary is proved, Hence the investigation without prior inclination towards guilt or unjustified acquittal.
