Abstract

The heavenly laws and Islamic law more than fourteen centuries ago stipulated human freedom, and not to be subjected to it arbitrarily except for reasons mentioned in the legal and statutory texts, so many Arab and foreign constitutions and systems stipulated the principle that it is not permissible to arrest, imprison, or search a person, except in accordance with the provisions of the system or law, and stipulate the right of defense for the accused, and that the accused is innocent until proven guilty in regular and fair legal courts, and stipulating not to harm the accused Physically and morally. "However, this freedom is not an absolute freedom by which individuals within society and on earth are allowed free to do whatever they please, even if they prejudice the interest of others or their State and society. Freedom is an inherent condition in every person and is of interest to all legal systems, whether domestic or international, but at the very moment that those systems grant freedom to individuals, they place sufficient restrictions to infringe on that freedom whenever the interest of society so requires.
