The element of error in tort liability for the act of others - a comparative study.

Abstract

Since the interests of the people renewed by the renewal of time, and since each individual may seek to achieve the interests of himself without looking at others, Islamic law and positive law came to surround these interests with limits so that if they were breached or infringed upon by any person by mistake, he was responsible before God and before the law, and that surrounding Islamic law with the subject of error indicates a clear indication that the wise street paid great attention to the rights of the people and the provisions related to them, and that Sharia Islamic aims to live members of society without conflict or conflict with regard to rights and duties, as well as positive law aims in all its provisions to non-conflict and conflict between members of society so occupied the subject of the corner of error in tort a great place in it because of the advantage of this subject of the application of practical continuous and continuous and closely linked to current life, hence the importance of research on this subject and replacement and renewal in order to keep pace with this renewal developments in practical life.
