Oversight: oversight of omissions and means of addressing them in the constitutional judiciary and their impact on legislative reform

Abstract

Judicial oversight of the constitutionality of laws and regulations is the greatest effective guarantee of constitutional legitimacy and upholding the rule of the constitution, and the research has resulted in the fact that oversight of omission achieves the principle of balance of powers in favor of constitutional legitimacy. As well as achieving a balance between upholding the rule of the constitution and achieving the principle of its supremacy and maintaining stability within the state. However, the control of the Supreme Constitutional Court does not stop at controlling the legislator's positive activity, but extended to his negative activity as well, and that judicial control over legislative omission is one of the most important tools to modify the course of the legislator's deviation.
