The subject of this research is the aggravating circumstances of the penalty in the crime of arresting persons and imprisoning them without right, and it is known that the crime of arrest, imprisonment or detention of persons without the right affects the personal freedom of man It is the most precious thing he owns in existence and mainly affects his freedom of movement, going and coming and choosing a place of residence, and the various penal legislation has decided penalties for that crime, which vary from one legislation to another and from one country to another, the criminal legislator may increase the penalty in some crimes if accompanied by certain circumstances or conditions, in order to achieve the purpose for which the punishment was legislated, which is to achieve deterrence and reprisal.
