Punishment in the crime of forced displacement (a comparative study)

Abstract

Legislation expresses the opinion of the ruling class in society, and is thus the product of the authority's policy in this area, whose texts must be in a way that serves its interests and is in its interest, so most of the world's legislation is free of any punishment for those who abandon others from their homes, as it was developed in a time of stability in which these violations can only occur with its consent. But we found them appearing in times of war or the imbalances that afflict society in its structure. Despite the internal punitive legislative deficiency, international efforts have been made to address displacement. But it was not successful in dealing with them, as it conflicted in taking it between (war crimes, against humanity, genocide), and the international community has not yet come up with any product that can combat or reduce these violations, especially since forced displacement has become an inherent characteristic of all international and internal conflicts, especially modern ones, whose material and moral images are located, with every action that would achieve them.
