This research deals with the emergence and consolidation of the idea of punishment in civil law, especially with regard to financial penalties, although this idea seems to be absent from the purposes of civil law. Indeed, the civil law aims to regulate civil transactions between individuals, including contractual liability that includes the idea of a threatening fine, and a tort liability focused on compensation for damages. The error has no role in this latter case except that it is the basis for the judgment of compensation and is not subject to punishment, and therefore is not a criterion for estimating the amount of compensation.
