Abstract

Praise be to God alone, and prayers and peace be upon the one after whom there will be no prophet. The state, while carrying out its duty to combat crime, pursue its perpetrators, investigate them,
and prosecute them in a manner that achieves private deterrence and general deterrence, must undertake this task without prejudice against the accused, and A balance between the right
of society to inflict punishment on criminals, and the right of the accused to have the investigation procedures surrounded by guarantees that prevent the arbitrariness of the investigating authority,
in accordance with regular rules that regulate the conduct of the criminal case arising from the crime from the moment of its commission until the issuance of a final judgment in it and the method
of implementing the judgment, and these are called Procedures related to criminal procedures, the most important of which is the procedure on which the decision to continue the criminal
case and refer it to the judiciary is based.
