The Legal Framework governing electronic education under Kuwaiti Law

Abstract

Many technological developments in the field of information and communication technology have affected the educational process in recent years, especially with the expansion of the use of computers and modern means of communication, that have positively affected the course of education regarding the method of teaching and the acquisition of sciences of all kinds. E-learning provides educational content that can be actively interacted, whether synchronous or asynchronous between the teacher and the student, which facilitated the learning process and made it more flexible, while the importance of this type of learning has increased greatly due to the Coronavirus (COVID-19) pandemic that has swept the world. The development of educational services through e-learning necessarily entails the emergence of new patterns of transactions that were not previously known, so we must face the legal void in this regard, as this topic relates to several laws that must be clarified which are related to electronic transactions and consumer protection and in large part with the protection of rights of the author. The essence of e-learning reveals to us the relationships arising from the service of this learning and legal adaptation to it in order to reach the obligations arising from that service.
