The concept of third parties within the scope of contractual liability

Abstract

One of the issues that witnessed doctrinal disagreement is the issue of determining what is meant by third parties in the field of contracts, and in front of the absence of a specific definition of others, which is logical, since the idea of others differs according to its content and meaning, and therefore it is important for the idea and not the term. In this chapter, we are exposed to the definition of others through the presentation of the historical origin of the term, then we address the idea of others and the binding effect of the contract or more precisely we are exposed to the term through the principle of the relative impact of the contract, and this is the focus of the first section of this chapter, and then we address the second explanation.
