Damage in the framework of medical liability - a comparative study

Abstract

The medical profession has been  known since ancient times, as it is considered a humanitarian, ethical and scientific profession. Its roots extend to the depths of history and this profession gradually developed into what it has reached at the present time. Especially with the emergence of modern treatment methods, the expansion of medical and biological works, the use of advanced medical devices on the patient's body in order to eliminate the diseases that the patient suffers from. However, this development is accompanied by a rise in risks, a widening degree of potential for damage, and a large number of problems resulting from the exposure of patients undergoing treatment or who have been exhausted from services to various damages. We have dealt with the issue of damage within the framework of civil liability as it is one of the pillars of civil liability and the theoretical concept of damage and the material and physical harm that comes from it that affects the human body. Then we showed the practical concept of the damage and the extent of the ability to prove responsibility and compensate the injured in light of the aggravation and complexity of the damage, And it dealt with reviewing all the elements of compensation to achieve the greatest amount of justice for the injured person and the parties financing this compensation.
