Abstract

 The preliminary investigation stage is considered one of the most dangerous stages of a criminal case against human rights, as this stage involves many measures affecting personal freedom, and it clearly shows the extent of the conflict between the state's right to punishment and the preservation of guarantees and human rights, and the primacy of one over the other due to the policy pursued by the state In dealing with its citizens, in the police state, human rights are violated, and the state’s authoritarianism and sacrifice of the freedoms of its citizens despite maintaining the security of the state appears, and these systems often appear in developing countries, unlike democratic countries that value the human being and seek to give him more guarantees. All this clearly shows During this stage, the authority in charge of this stage possesses the powers and capabilities that guarantee the storming of the rights and freedoms of citizens unless this authority is restricted and subject to judicial oversight, in addition to its assignment to an independent and impartial body.
