Criminal Liability Arising from Climate Crimes in UAE Law

Abstract

Climate phenomenon, resulting from human interventions and activities, has cast a shadow over all sectors and led to a huge number of radical changes, affecting the natural and human environmental balances worldwide. It has become one of the most challenges facing societies and preoccupying specialists, this is due to the random activities carried out by man and increasing population, in addition to the industrial and technological revolution that covered various fields the world, especially multi-purpose industries , nuclear disasters and wars, and natural causes such as volcanoes, earthquakes, and multiple and continuous accumulations at present time, which negatively affected ecosystem stability and components. This was reflected in the high temperature of the atmosphere surrounding the earth and global climate change causing damages to living organisms, primarily humans. Therefore, states realized these risks and began searching for the methods to confront this phenomenon and the necessity of setting controls. International agreements were concluded regarding environmental protection. National legislation also intervened and issued special laws to protect the environment, and established the general framework for its protection, including criminal, civil and administrative penalties imposed on perpetrators of environmental crimes.
