For Effective Judicial Protection of Nature

Abstract

Since the human existence on earth, mutual influence has been observed between man and the nature. We live in an environment where the destinies of all living beings are intertwined. It goes without saying that the welfare of human beings is correlated with their respect for nature; both parties have interests that are not competitive but interdependent. However, the ecological crisis is rooted in the fact that legal systems are based on the human control over nature, rather than on mutually beneficial relation between both parties. It should be admitted that such unprecedented development of environmental standards over the past few decades have not provided for sufficient protection of the nature. The world is witnessing some aggravating ecological phenomena such as the climate change, biodiversity loss, ecosystem degradation, desertification, and so on. Therefore, a course of action should be settled on for developing new regulations and policies in conformity with the performance of ecosystems, ensuring their resilience and continuous effective functionality.
