Abstract

Climate change and its environmental damage has become one of the most important emerging issues raised in the legal arena, especially in light of the weak legal treatment to regulate the right to climate safety. So; Through this research, we seek to shed light on the weak treatment of the constitutional legislator and the national judiciary to the phenomenon of climate change in Egypt and the majority of countries, despite the seriousness of this phenomenon on biodiversity. Fighting desertification and caring for green belts. We also seek through this research to determine the legal basis for civil liability for environmental damage resulting from climate change, and compensation for it. The judge must rely on them to determine the value of compensation, as well as to develop complementary mechanisms for the compensation system.It is clear from our treatment of the issue of legal protection of the climate that the Egyptian legislator has a radical task to determine the legal basis for the civil liability of the person who harms the climate and whose work causes greenhouse gas emissions.
