Legal Aspects of Remote Examination and Diagnosis: An Analytical Study in the Light of the Saudi System and Islamic Jurisprudence

Abstract

Tele-health represents a form of medical work, using communication and information technology and the Internet, with the aim of diagnosing, medical decisions and prescribing treatment, and therefore remote health care achieves many advantages, which prompted many countries such as France, the United States of America, and some Arab countries Such as the UAE, Morocco, and the Kingdom of Saudi Arabia to pay attention to the issue of telehealth and make legislative endeavors to establish a legal framework for it that governs the way it is practiced and defines the civil responsibility of the doctor, the medical and professional institutions, and the technicians involved in operating modern medical devices and tools that operate with telematics technology. This paper dealt with the definition of telehealth and its importance. Also, discussed the risks of telemedicine. On the other hand, the research clarified the mechanism of remote examination and diagnosis according to the rules of Islamic jurisprudence and the relevant Saudi health systems in Saudi Arabia. The paper showed the physician’s commitment to ensuring patient safety in cases of telemedicine, from the point of view of Islamic jurisprudence and related health systems in Saudi Arabia. In the end, several recommendations were presented regarding telemedicine, which would develop a technical work system that guarantees the health and safety of patients.
