Abstract

The importance of administrative contracts has increased in the modern era, both at the internal level due to the tendency of developing countries to a free economy and dependence mainly on the private sector, under this system, the state can, through administrative contracts, especially the commitment contract, entrust the management of the public sector to the private sector in accordance with a system agreed upon by the parties to the contract, and at the international level, In this context, new forms and modern legal systems such as arbitration and B.O.T contracts have emerged, which are construction, operation and transfer contracts, which is a development of contracts for the commitment of public utilities and one of the best ways for these countries is to contract with the system of construction, operation and transfer of ownership contracts known as B.O.T.
