Abstract

During their stages of development, States go through exceptional or unusual circumstances. It may be caused by man: wars, armed rebellion, coup... etc., and may be due to nature: floods, volcanoes, earthquakes, epidemics.... etc., which may pose a threat to public order and to the security and safety of the State. Existing legislation – originally designed for normal circumstances – often stands- Exceptional circumstances constitute a conflict between two considerations: the preservation of the entity and integrity of the State on the one hand, and the obligation to respect the rules of law on the other hand, which requires finding appropriate legislative solutions to achieve these two considerations.
