Powers of the Prosecutor at the International Criminal Court in the investigation and trial phases

Abstract

This research concluded to indicate the nature of the work of the Prosecutor at the International Criminal Court, and through this research we found that, the Rome Statute of the International Criminal Court identified the crimes that fall within the jurisdiction of the International Criminal Court, and that the initiation of the international criminal case is either through the internal prosecution through referral from a state party or by the Prosecutor or through the external prosecution Through the United Nations Security Council or through any country that is not a party, we also found that the Prosecutor must obtain permission from the Pre-Trial Chamber before initiating any investigative procedure, and it is the powers of the Prosecutor to move to the countries where international crimes are committed, issue an arrest warrant and summons to appear, in addition to approving charges The general is responsible for listing all evidence related to the accusation or innocence, and therefore it is not an adversary in the proceedings, but it must disclose it if any evidence emerges proving that the accused is innocent.
