The nature of transitional justice (a comparative study)

Abstract

Transitional justice is the set of judicial and non-judicial measures that states apply to address the gross human rights violations inherited from authoritarian regimes, including prosecutions and truth commissions. Reparations programs and various forms of reform of state institutions, and transitional criminal justice is not a special type of justice, but an approach to achieving justice in criminal law in periods of transition from conflict or state repression, and by trying to achieve accountability and compensation for victims, transitional justice provides recognition of victims' rights, encourages civic trust, and strengthens the rule of law and democracy.
