The effects of the Corona pandemic on the Kuwaiti National Assembly's assumption of its responsibilities and the performance of its constitutional and legal powers (Inductive and analytical study)

Abstract

In light of the exceptional circumstances imposed by the Corona pandemic on many state institutions and determining their way of dealing with them, by balancing the risks that threaten the health and security of individuals on the one hand, and meeting their needs and respecting their basic rights guaranteed by constitutions and laws on the other hand, the Kuwaiti National Assembly found itself facing a new and exceptional event, and obstacles that needed to be rearranged and balanced priorities, to address the danger resulting from this pandemic and carry out its constitutional powers. And to play this role in light of the danger that Represented by this deadly epidemic that swept the world, the Council needed to know the constitutional and legal principles and rules that help it to perform its role to help the state and individuals overcome this pandemic, and also to emphasize its independence and the need to continue to exercise its competencies under a democratic system that respects political rights, as well as respects the principle of legality and the rule of law. This study emphasizes the importance of the role of parliament in facing crises, and the importance of finding the required balance between the rights of health, security and life and the right to representation and prosecution and the preservation of public funds.
