Abstract

This research deals with the problem of dealing with the person accused of a terrorist crime, whether in the evidence-gathering stage, the preliminary investigation stage, or the trial stage. We did this by commenting on a ruling issued by the Doha Criminal Court (Qatar), which was confirmed by the ruling of the Doha Court of Appeal in 2023, which dealt with terrorist crimes in terms of explaining their elements and methods of proving them, concluding the acquittal of the accused. The research did not neglect the situation in the comparative law in the treatment of those accused of a terrorist crime to solve the problem of the contradiction between the state’s right to security and the right of the accused of a terrorist crime to a fair lawsuit. In this contradiction between the two matters, we tried to find a way of balance between the two conflicting considerations to confirm that the accused of this type of crime has a right to a fair lawsuit, but this right differs to some extent from the accused of an ordinary crime. That is the subject of the legal problem addressed in this research.
