Criminal confrontation of the crime of extortion and threats through social media in UAE law (a comparative study)

Abstract

The aim of the research is to define what is meant by the crime of extortion and intimidation through social media and its most important methods, and to identify the legal structure of the crimes of extortion and intimidation, and to review the penalties and penal measures prescribed for them in the UAE and Egyptian legislation, and to indicate the adequacy of the legal texts in the criminal confrontation of the crime of extortion and intimidation via social media in UAE legislation compared to Egyptian legislation. The research relied on the analytical fundamentalist approach, by describing the issue of extortion and threats through social media, and analyzing legal texts, jurisprudential opinions and judicial rulings. The research reached several results, the most important of which is that the Emirati legislator has increased the penalty in the event of committing the crimes of extortion and threatening through social media, given the danger it poses to members of society, especially what offends their honor or consideration. Cases of aggravating the sentence to be aggravated imprisonment exclusively, without increasing or expanding it. The research recommended that the Egyptian legislator follow the example of the UAE legislator by adding new penal measures against the perpetrators of cybercrimes, as he only provided for the two measures of closing and blocking the site, and that the penal measures are effective legislative tools in order to achieve the protection of society from cybercrime.
