State compensation for damages caused by civil wars in Islamic jurisprudence and positive law.

Abstract

The human soul is the most precious and precious thing in existence, and heavenly laws, constitutions, treaties and man-made laws have given this right, and considered it one of the basic rules and gave it protection and preservation. The right to life is the first right of a person, followed by the other rights begin and are applied, and when it ends, the other rights end and are absent, and this right was granted by God - Almighty - to man, so any attack on him is considered a crime and an attack on the individual and society as a whole. The right to life is a sacred right that must be preserved and nurtured and not infringed upon without justification or legal or legal basis, retribution from the perpetrators of crimes, and compensation for the injured in this attack, whether this compensation is from the aggressor or his mind if possible, and whether the state adheres to it as the negligent and responsible for preserving and protecting this right or not. the principle of legality on which the legal state is based, Rather, the State must preserve rights and freedoms, achieve security and justice and preserve people's lives.
