Constitutional consecration of the right to social security.

Abstract

The right to social security is regulated under the second generation of human rights, classified as social rights. The International Covenant on Economic, Social and Cultural Rights, which regulates this right, allows States parties to it to gradually realize the recognized rights in accordance with their available resources and national priorities. The Supreme Constitutional Court affirmed this by saying: "The provision of cultural, social and health services by the State in accordance with the provisions of Article 16 of the Constitution requires positive intervention by relying on its own resources available in accordance with its capabilities, so that its satisfaction of its services is gradual and within the limits of its capabilities, contrary to its position on negative individual rights, which it is sufficient to preserve by simply refraining from interfering in their scope in a way that restricts or disrupts the origin of the right."
