Disadvantages of administrative decisions related to the deportation of foreigners and judicial control in Egyptian and UAE law .

Abstract

A State can exercise all aspects of its sovereignty over its territory, whether internal sovereignty or external sovereignty. The manifestations of internal sovereignty are manifested in the freedom of the State to dispose of its internal affairs, to organize its Government and public utilities and to impose its authority over all persons and objects that exist on its territory, as a result of which no State or other body may exercise its authority in the territory of the State.  It is recognized that the State has the power within its territory to regulate aspects of human life with a view to achieving security, justice and well-being. The role of judicial oversight of the internal legality of decisions relating to foreigners constitutes the basic guarantee for the protection of the rights and freedoms of foreigners in the State of law. Therefore, it is defined as the control exercised by the judiciary over the decisions issued by the administrative control authorities, represented by the head of state, the authorized minister, or the Minister of Interior, in addition to the special administrative control authorities, as for the control of internal legitimacy, it means the control exercised on the objective elements of these seizure decisions represented in the lack of jurisdiction of the authority issuing the decision, procedural and formal defects in the seizure decision, and the defect of violating the law.
