Freedom of expression is the basis for many freedoms, on top of which is the freedom of assembly and peaceful demonstration, and this freedom has become the most traded these days, whether in Kuwait or in the Arab countries, steadily and almost daily, especially after the collapse of individual totalitarian regimes, which were narrowing the exercise of freedom and making it a theoretical freedom that is approved by the constitution and addressed by jurists in their writings without having any tangible impact on the ground. Freedom of assembly and peaceful demonstration was negatively affected. That freedom that enables individuals to present their opinions and ideas and put forward their collective hopes and ambitions as long as these individuals do not depart from the framework set by the law for the exercise of freedom, where this freedom is a source of enrichment of thought and a means to reach the right decisions, and due to its importance to the individual and the group, most democratic constitutions and international conventions were keen to stipulate them explicitly and provide all the necessary guarantees to enjoy them in reality and in law, And made the basic task of the State is to protect these guarantees and ensure the greatest amount of rights and freedoms for individuals, including the freedom of assembly and peaceful demonstration, this freedom, like most public freedoms, is not absolute, but restricted by some controls or restrictions necessary to organize social life, for the necessity of human life with others in an organized society requires that his freedom be restricted and organized by regulatory and penal controls that ensure the enjoyment of all their freedoms so that the freedom of the individual ends at the limits of the freedom of others, If the legislator recognizes the freedom of assembly and peaceful demonstration of the individual, it is necessary at the same time to regulate the exercise of freedom to avoid and prevent abuses that occur in the place of meeting or demonstration, without disturbing public order that may occur on the public road because of such demonstrations, which may turn into a legally criminal gathering accompanied by acts of violence as a result of the gathering of those numbers of masses.
