Freedom of expression is the basis for many freedoms, on top of which is the freedom of assembly and peaceful demonstration, and this freedom has become the most traded these days, whether in Kuwait or in the Arab countries, steadily and almost daily, especially after the collapse of individual totalitarian regimes, which were narrowing the exercise of freedom and making it a theoretical freedom that is approved by the constitution and addressed by jurists in their writings without having any tangible impact on the ground. The freedom of assembly and peaceful demonstration has been negatively affected, which enables individuals to present their opinions and ideas and put forward their collective hopes and aspirations as long as these individuals do not deviate from the framework set by the law for the exercise of freedom, where this freedom is a source of enrichment of thought and a means to reach the right decisions.In view of its importance to the individual and the group, most democratic constitutions and international conventions were keen to stipulate them explicitly and provide all the necessary guarantees to enjoy them in reality and in law, and made the main task of the state is to protect these guarantees and ensure the greatest amount of rights and freedoms for individuals, including the freedom of assembly and peaceful demonstration, this freedom, like most public freedoms, is not absolute, but rather restricted by some controls or restrictions necessary to organize social life. If the legislator recognizes the freedom of assembly and peaceful demonstration, it is necessary at the same time to organize the exercise of freedom to work to avoid and prevent abuses that occur in the place of meeting or demonstration, Without disturbing public order, which may occur on the public road due to these demonstrations, which may turn into a criminal gathering by law accompanied by acts of violence as a result of the gathering of these numbers of people.
