The independence and development of the constitutional judiciary in the Sultanate of Oman and comparative law.

Abstract

The independence of the constitutional judiciary in the legal state is considered a real protector of rights and freedoms and an actual restriction on the exercise of power so that it does not deviate from the path of law. There are means that enable constitutional oversight, and these means are not specific, but rather several, including the constitutional judiciary’s singularity in adjudicating disputes related to the extent to which the legislative text conforms to the Constitution or not. Judges are dismissed, which supports the independence of the constitutional judiciary. Various Arab regimes have developed to develop the necessary frameworks to ensure the independence of this type of judiciary.
