The legal system for the liability lawsuit against the air carrier for the risks of air terrorism and the litigation of the insurance company.

Abstract

States and international institutions are witnessing continuous legal developments to deal with security challenges and legal issues related to air terrorism. The legal system must verify the compatibility between preserving the rights of passengers and assuming the appropriate liability of the air carrier and insurance companies. If the aircraft is subjected to a terrorist attack in the sense of the above explained and resulted in damage to one of the passengers, the latter has the right to file a civil lawsuit against the air carrier by obliging him to pay compensation for the damage suffered, and international conventions have regulated the liability lawsuit through its statement to the court with jurisdiction to separate the disputants, but It also ignored some other fundamental issues, which should be returned to the national legislation of the competent court to hear the dispute.
