Abstract

Working with the electronic court system, taking advantage of information technology, and creating modern means and systems that enable people to register their claims, pay their fees, have the parties or their agents present, provide evidence of proof and pleading, submit appeals, and carry out all procedures through electronic means that differ from traditional means, as they are characterized by the speed of completing claims and simplifying litigation procedures. From anywhere without personal presence, The court has the right to do all of this, accompanied by maintaining the security of documents submitted electronically, protecting them from tampering, and making them accessible to authorized persons.The real question arises as to whether the use of electronic litigation means helps reduce and limit corruption by documenting litigants’ requests, defenses, and memorandums in a way that does not allow anyone to tamper with the wording, so no one can delete, add, or abbreviate the phrases contained in any document.In addition, dealing with claimants or representing them remotely (by accessing the court’s digital website) leads to reducing the participation of those who attend the trials, restricting them and following them up on the one hand, and working to save effort among them by knowing the successive measures digitally, which has contributed to reducing the downtime. Saving time for office management, I specialized in managing representation and aid newspapers and restricting them in logging in, so we examined the effort in the documents and classified them according to their topics.As well as providing time to notify him or his representative of the case or its evidence, or informing it digitally to activate it, it also leads to reducing the dates for attendance and the legally specified distance, and speeding up the determination of the first session for consideration and information by specifying it automatically, and preventing the human element from tampering with it.It also prevents the loss, destruction, or forgery of opponents’ documents, or at least the ability to determine who is responsible for that or not?From this, it is necessary to recognize the dimensions of the impact of the use of electronic litigation on reducing corruption, and to what extent this approach affects the increase and speed of adjudication of lawsuits before the judiciary.
