Abstract

Investment has become one of the most important pillars on which countries depend in economic activity, as it enhances wealth and stimulates productive capacity, and its role is no longer limited to establishing a productive base in the country in which it is invested, but extended to include creating job opportunities, reducing unemployment, and providing goods and services, which enhances trade and pushes exports, and leads to the flow of foreign currency to the homeland, to be reinvested in existing or new projects. The recent period has witnessed the reluctance of many investors to invest their wealth in certain countries or specific sectors, as a result of the absence of a clear legal vision that guarantees them the guarantee of their rights and the preservation of their investments, and the investor's lack of confidence in the existence of an effective, independent, fair and specialized judiciary that applies the legal provisions that guarantee him this security in investing his funds; The investor never ventures to invest his money in a country, unless he is safe from abuse and misunderstanding, through a fair and specialized judiciary that guarantees the protection of his rights, through effective and quick judicial rulings. Hence, most countries have tended to enact legislation that ensures the protection of investment and commercial activity, and makes the investor safe from damage to his money and investments, which is an important and positive step in encouraging investment and increasing commercial activity, but the law alone is not enough to achieve this protection, if there is no judicial authority that is determined to protect it and apply it to the best possible, at a time when the role of the judiciary is no longer limited to resolving disputes between two parties to a disputed right, but rather leads An important role in achieving comprehensive development and consolidating the rule of law.
