Abstract

Article 6 of Act No. 146 of 2019, amending certain provisions of the Economic Courts Act, deals with the non-criminal jurisdiction of economic courts, which includes certain commercial cases, such as the Companies Act on the receipt of funds for investment, the Commercial Agency and Bank Operations. Trade disputes are of a special nature and are derived from the nature of commercial matters based on the movement of international and domestic capital and investment. This entails the adoption of a special system of litigation which differs from the general rules of litigation. Thus, the scope of the use of modern techniques for moving commercial cases before the Economic Court according of Act No. 146 of 2019, such as procedures for filing such cases before the Economic Court, procedures for preparation and mediation, electronic appeals procedures and paper procedures for appeals in cassation.
