Abstract

Criminal capacity is a moral pillar of criminal responsibility, which means the mental and psychological state of the offender at the moment of committing criminal behavior or abstention sinful legally, which is therefore not a purely legal idea, but it is one of the basics of the attention of psychology, which cares about human behavior, and if the elements of criminal capacity, are perception and will, psychology is entrusted with research in the depths of the human soul, but it is the one that determines the framework of those elements, the psychological treatment of criminal responsibility occupied the attention of psychologists and legal scientists, if Criminal responsibility was concerned with the general legal concept of convicting the perpetrator of criminal behavior, it requires standing on many psychological processes that determine the degree of criminal sin.
