Abstract

Criminal law in the modern era is characterized by employing its rules to contribute to the development of society by following a legislative policy aimed at linking legislation with social and economic perceptions in society so that there is a link between these transformations and legislation. The emergence of criminal philosophy - which is linked to the general philosophical climate prevailing in society, has been credited with shedding light on criminal policy and its objectives of linking legislation to the social, economic and political variables prevailing in society through its three branches of criminalization, punishment and prevention policy. Jurisprudence on criminal law has recognized a positive role in the development of society, and the concept of the function of penal law from protection to guidance has begun to shift. Criminal philosophy is the search in the nature of criminal law or try to define it by identifying its source, subject and function or the goals it targets and these things are subject to the general philosophical climate prevailing in society at a time of times and in the stages of development of philosophical criminal thought can distinguish between three philosophies are traditional philosophy, positivism and philosophy of social defense, for more detail, Dr. Ali Rashid.
