Criminalization of persecution in international agreements.

Abstract

Difference is a universal phenomenon recognized by the wise legislator in his creation, and it is a principle of this life. It is not at all possible to find uniformity among all creation in every aspect; rather, difference is one of the necessities of life and a form of integration for the purpose of coming together and getting to know each other, as confirmed by the words of Allah: "And We have made you into nations and tribes so that you may know one another" (Verse 13 - Surah Al-Hujurat). Therefore, difference should be seen as a natural occurrence in thoughts, religions, customs, traditions, and opinions. However, it is strange that a particular entity or group tries to impose its opinion or thought and forces other groups to follow it; otherwise, those groups would be subjected to bad and harsh treatment due to their adherence to a specific doctrine or religion, or because of their language or color. The matter that leads to persecution crimes – and this is the focus of our discussion – from this standpoint, we can say that diversity is a richness in thought; without the differences among people, life would move in a single direction, and the world would suffer from intellectual stagnation. However, despite this, we find that some groups or individuals have become victims – at the hands of other groups – not for committing any crime other than adhering to a particular doctrine or religion, or because of their color or language, which has consequently led to the persecution of entire groups.
