Criminal mediation emerged in France as a result of the judicial practices that were carried out before it was delineated in the French Code of Criminal Procedure; it did not see the light based on the desire of the French legislator, but rather it was a codification of what was already established and practiced in the judicial work. Mediation appeared initially from the judicial, social, and educational oversight exercised by associations, which proposed social, psychological, and educational care as an alternative to imprisoning the accused, with the aim of reintegrating them into society and preventing their return to crime. This solution took into account the seriousness of the crime committed in addition to its concern for the victim.
