The topic of the study discusses the importance of international treaties and their status before the constitutional judiciary, considering them as a source of great significance in international law. This importance extends to the level of domestic law through the international obligations imposed on the state from both sides: the international side, which entails international responsibility towards the states parties to the treaty, and the national side, which requires the state to enforce the treaty within its legal system. This requires going through constitutional procedures because treaties are subject to the constitution, which grants them legal value, allowing them to occupy their place within the domestic legal system according to the principle of legal hierarchy. Consequently, they take precedence over laws in various aspects, such as legislation issued by the legislative authority and regulatory rules issued by the regulatory authority. This imposes numerous obligations on the executive, legislative, and judicial powers, as well as oversight authorities. Therefore, the judiciary must exclude legislation and regulations that conflict with the effective treaties ratified by the state in the disputes presented before it.
