The provisions of criminalization and penalties for promoting medical products without a license in UAE legislation: A comparative study.

Abstract

The research aims to clarify the provisions of criminalization and penalties for promoting medical products without a license under Emirati legislation, through Federal Decree-Law No. (34) of 2021 regarding the combating of rumors and electronic crimes, according to the text of Article (49) on promoting medical products without a license and the adequacy of the law in providing legal protection for consumers against the risks of those medical products on individual and community health. This is according to a research plan consisting of two sections. In the first section, we discussed the concept of medical products, and in the second section, we addressed the crime of promoting medical products without a license, comparing it with comparative legislation such as French and Egyptian law. The research relied on a comparative analytical approach and reached several results, the most important of which is that the conditions for licensing medical products set by the Emirati legislator are consistent with those in comparative legislation, with some differences in certain details which we clarified in the body of the research.
