God Almighty honored humans and granted them many rights, and from this standpoint, countries have concerned themselves in their domestic legislations with protecting individuals from the crimes of human trafficking. Among these legislations is criminal law, as it is well known that one of the most important functions of criminal law is to protect the basic interests of individuals and society. The crime of human trafficking is considered one of the important issues that occupies significant attention at both the national and international levels, despite its emergence after the end of World War II. However, its manifestations have significantly escalated at present and have become a danger to the security and stability of the countries, especially for developed and wealthy nations as they are destinations for illegal immigrants, and for developing countries as they are transit or source nations. Often, illegal immigration results in many tragedies and problems for individuals and communities. Illegal immigration is defined as crossing a country through unlawful means without official documents and without the approval of the state authorities. Some legal scholars have also defined it as the unlawful entry of individuals across the national borders of a country that is not their own, without adhering to the necessary conditions for legal entry into that country.
