The existence of public service is as old as the state itself; whenever a state is established, public service is established alongside it because it requires individuals to carry out its numerous tasks. Therefore, it resorts to appointing the most qualified among its citizens to perform these tasks on its behalf. Public jobs are considered one of the citizens' public rights based on equality among them under similar circumstances and according to the provisions of the law; citizens are equal in rights and duties, and every citizen has the right to engage in public service. However, this right is not unrestricted but rather exercised under specific conditions that match the nature of each job. It is generally agreed that when an employee commits any act that violates the duties of public service, it constitutes a violation and breach of the primary purpose for which public service was created. In this case, it is the right of the administration to take the necessary disciplinary measures against this employee and to punish him for the offense he committed against it within the framework of the law. This offense, in addition to being a disciplinary crime, may also classify as a criminal offense under the Penal Code. In such a case, is the administration allowed to limit itself to administrative punishment, or can it refer him to the competent court for prosecution regarding the committed offense? And if he is referred to the criminal court, what is the effect of the decisions issued by this court, whether convicting or acquitting, on the decisions of the disciplinary councils?
