Assessment of the Legal Framework for Administrative Supply Contracts in Light of UAE Laws and Regulations.

Abstract

An administrative supply contract is one of the types of administrative contracts representing an agreement between a legal entity and an individual or an organization. Supply contracts are entered into with the mutual consent to create a specific legal effect. The federal legislator has defined a specific path for concluding supply contracts within the field of the United Arab Emirates legislation. Therefore, the study aimed to understand the legal framework of the administrative supply contract in UAE legislation, and to achieve these objectives, a descriptive analytical approach was employed. The study yielded numerous findings, with the most significant among them being of which is that the supply contract is considered an administrative contract by defining the law, because it is related to public works, and it appears through the definition of the administrative contract that in order for the supply contract to be administrative, three conditions must be met, namely that one of the parties to the contract be a person of public law, and the connection of the contract Actively a public utility, and the administration follows the common law method in contracting.
