The adaptation of the relationship between public employees and the administration in the Kingdom of Saudi Arabia: "A study in light of judicial rulings and the administrative system"

Abstract

The research seeks to clarify the relationship between public employees and public facilities in the Saudi administrative system and judiciary, with the aim of identifying the implications and consequences of this relationship. To achieve this, several research methods were employed, including analytical, historical, and descriptive approaches, by reviewing the principles and judicial rulings issued by the Saudi administrative judiciary, in addition to the texts of relevant administrative regulations. Through this, several conclusions were reached, the most important of which are the requirement for continuity in the work performed by public employees within the public facility, the different definitions of public employees according to each branch of law, and the fact that the term "public employee" does not apply to everyone working in a public facility, as some work there and are subject to the labor law. Furthermore, the relationship between them is a legal one, subject to the state's regulations. Therefore, any agreement that contravenes the provisions of the regulations is null and void. Recommendations emphasized the need to include clear and explicit legal texts in relevant regulations that clarify this relationship and its resulting implications.
