Privacy of legal protection for real estate developmentIn light of UAE legislation "Analytical Study"

The term “real estate developer” - or (real estate development companies) - One of the modern legal terms imposed by practical reality in the real estate market, real estate development is bound by several obligations imposed by the laws regulating the off-plan property sale contract, and it is required to fulfill these obligations before contracting to sell the real estate units. Perhaps the first and most important of these obligations is the real estate developer’s obligation to build according to specifications, in addition to his obligation to deliver and transfer ownership. There are a number of other obligations after contracting and delivery. The developer who violates the contract for the sale of real estate off-plan may be punished with several penalties. These penalties may be civil, as the developer must implement his obligations in kind. If he does not do so voluntarily and willingly, he must fulfill his obligations whenever possible. The legislator also gave the buyer the right to demand cancellation and compensation if the developer does not fulfill his obligations in kind. In addition, these penalties may be criminal or administrative.  Therefore, through this research, we seek to shed light on the specificity of legal protection for real estate development in light of Emirati legislation by analyzing the legislative texts specific to the UAE, given its pioneering advantage in this category of contracts. Consequently, the weakness of the Egyptian legislator's treatment of these contracts is clearly evident. Therefore, this research covers two topics: the first: the obligations of real estate developers under UAE legislation, while the second section addresses the penalties imposed on violating real estate developers under UAE legislation.
