Guarantees of the accused during the trial stage via remote communication technology in Emirati legislation.

The aim of this research is to demonstrate the effectiveness and efficiency of the UAE legislator's treatment of the defendant's guarantees in light of the use of telecommunication technology in criminal trials, by clarifying the scope and mechanisms of applying trial procedures through remote communication technology, and identifying the formal and objective guarantees of the accused in the criminal trial stage through Remote communication, this research relied on the descriptive analytical approach, by analyzing the legal texts related to the subject of research in the Federal Penal Procedures Law No. (35) of 1992, and Federal Law No. (5) of 2017 regarding the use of remote communication technology in Criminal procedures, and the research reached several results, the most important of which is that the electronic deliberation procedures and conditions do not differ from what is followed in traditional trials, as the UAE legislator stipulated that the deliberation be between the judges who heard the pleading together and be confidential, and through the remote communication technology that takes place via a website Insured provided by the court for this. The legislator also stipulated that only the court body should enter this electronic system in which the deliberations take place. The researcher recommended amending the text of Article (6) of the law Federal No. 5 of 2017 regarding the use of remote communication technology in criminal procedures, which allows the accused in the first session of his trial through remote communication technology in any degree of litigation to object to that trial and request his presence in person before the court, by adding a text that allows the accused in That he accepts his trial remotely, or that he or his agent does not accept it while determining the first session of his trial via remote communication technology, and writes this matter in the case file
