Abstract

It has become evident that the role of the executive authority is increasing in the legislative field, through its constitutional right to propose laws. The proposal is the first important, influential, and effective building block in the legislative process; after its enactment, it has the right to object to it, which can result in its amendment or even its burial. The executive authority also enjoys quasi-absolute legislative powers in extraordinary circumstances, leading to a disruption of the balance between the legislative and executive authorities in favor of the latter. Thus, the theory of necessity has become one of the most important sources of exceptional legitimacy, and the executive authority has acquired the power of legislation as an evil that is necessary.
