The legislative confrontation of family crimes in Jordanian legislation (a comparative study).

Abstract

This study aims to identify the penal provisions that pertain to the family as stipulated in the Jordanian Penal Code, in addition to the Law on Protection from Domestic Violence and the Jordanian Personal Status Law. This is achieved by examining the actions that have been criminalized by the legislator, which are considered crimes that affect and take place within the family unit, including actions that the legislator has not specifically included within the scope of criminalization due to their absence from the Jordanian Penal Code. This study also addresses the concept of the family in various legislations and in the fields of human sciences and sociology. The importance of the family in Islam and in the social and human sciences is highlighted, along with the position of the Jordanian legislator regarding crimes that affect the family, whether through increasing penalties or even removing the criminal nature from certain actions.
