The limits of judicial oversight on expulsion decisions: A comparative study.

Abstract

The administrative judiciary exercises significant oversight over deportation decisions, and in this research, we will address judicial oversight of deportation decisions from two essential aspects. This study is structured into two sections: in the first section, we discussed the aspects of control over the legality of the administrative decision in terms of external and internal legality, divided into two requirements. The second section is dedicated to the practical aspect of this research, where we examined the position of the administrative judiciary, on one hand, and the position of the Supreme Administrative Court, on the other hand, also in two requirements. We concluded with a summary and a set of findings and recommendations.
