The study deals with the legal basis for the prohibition of abuse of the dominant position. The research explains the legislative prohibition of abuse of the dominant position in Egypt in Act No. 3 of 2005 by promulgating the Law on Protection of Competition and Prevention of Monopolistic Practices and other comparative legal legislation, in particular: - United States legislation (which looks at its father's antitrust law such as the Sherman Act) and other laws such as the "Clayton Act" and the "Federal Trade Act"), in addition to its anti-monopoly authorities: the Federal Trade Commission and the United States Department of Justice. - French legislation (not to mention the extent to which Egyptian law is influenced by French laws in various branches of law. The research reviews the successive developments in French legislation until it reached the Decree of 1 December 1986 on freedom of price and competition, which promulgated the Competition Act, and the numerous powers granted to the French Competition Authority (formerly the Competition Council) under the Economic Modernization Act and the McCrone Act). - European Union legislation (which is strict and precise with regard to the prohibition of abuse of the dominant position, the extent to which it has evolved from the Treaty of Rome establishing the European Community to the Treaty of Lisbon amending the Treaty of the European Union and the Treaty establishing the European Community, as well as the role of the European Commission in implementing competition protection policy
