The implications of initiating constitutional litigation through administrative courts.

Abstract

The issue of the consequences of filing a constitutional lawsuit through administrative judiciary is of great importance, as it allows the interested party to resort to administrative judiciary in order to protect their right on one hand, and to uphold the principle of constitutional legitimacy on the other hand. There are consequences that may arise as a result of filing this lawsuit, so anyone who resorts to administrative judiciary must adhere to the rules established by law to organize this recourse. The judiciary is the official authority responsible for resolving disputes, and what the legislator has set for litigation before this authority is only to facilitate individuals' right to seek justice if their rights have indeed been violated. Or was exposed to aggression against him. The importance of our topic lies in understanding the effects resulting from initiating constitutional action before the administrative judiciary, as it is considered a significant part that cannot be overlooked. There are procedures that occur before the issuance of the ruling; such as suspending the administrative case and the timeframe for initiating the constitutional action. There are also procedures after the issuance of the ruling, such as the authority of the constitutional ruling before the administrative judiciary, and the legal effect resulting from the ruling before the administrative judiciary.
